IRS Tax Problems Can Be Resolved In Tax Court

Taxpayers can get IRS Tax help for unresolved tax problems by taking the matter to Tax Court

As any experienced tax accountant or tax attorney know, the IRS and state often make mistakes when computing taxes owing. This can be a result of deficient records, payments from taxpayers that went astray, mistakes in interpreting the law and so on. As both tax attorneys and CPAs we understand what it takes to recognize and respond to IRS tax problems.

If the matter cannot be resolved through administrative means, you may have to take the IRS to court. The steps are essentially these:

  • There is a dispute about the amount of taxes owing
  • All administrative remedies have been exhausted without satisfactory resolution
  • The IRS will issue a Notice of Deficiency
  • The taxpayer has 90 days to file a response
  • There are no extensions or appeals, so it is important to deal with this within the 90 days. It could be possible to sue the IRS for a refund but you would have to pay the tax liability up front.

US Tax Court (IRS Tax Court)

  • Depending on the circumstances of the case, the US Tax Court could be the best option to litigate the IRS tax problem. If the main issues are the IRS code’s law or regulations, then this probably the best alternative.
  • The case is tried by a judge who is expert in tax law.
  • The alleged taxes owing do not have to be paid before this court will hear your case.

US District Court

  • The US District Court may be a more advantageous option if your case is about equality or fairness as it is tried before a judge and jury who may be more receptive to your situation.
  • Before this court can hear your case, the tax owing has to be paid.

The best option is to avoid IRS tax problems through comprehensive tax planning along with accurate record keeping and the timely filing of tax returns. All of which will reduce your likelihood of being audited. As tax attorneys and CPAs we can assist you with effective IRS tax help.
