A tax lien can arise from unpaid income taxes (IRS and/or state – California Franchise Tax Board), payroll taxes or sales taxes. The thing not to do is ignore it. If the government is attempting to collect a tax debt, you need to take action which we can help you with. The tax agency will typically start collection action with a notice or demand to pay.

For example, the IRS could issue you a “Notice and Demand for Payment” or threaten to file a lien on your assets. It is very easy for them to get a lien issued against overdue taxes which makes it “legal” for them to grab you assets. This can include automatic withdrawals from your bank account or the seizure and sale of assets such as cars, homes or investments. They will take things that they can convert into cash as soon as possible.

In certain cases there may be controversies that impact the original tax filings. Whatever the situation is, we can represent you against the government agency that is causing you grief.

These are the steps that the IRS takes:

1. They determine your tax owing which may or may not be the same as what you filed on your tax return.
2. They will send you a “Notice and Demand for Payment”. This is basically a bill from the government to you stating how much tax you owe. This should agree with the tax return that you filed. If not, an analysis would be done of the differences. I.e. why did they increase your tax liability? If you agree with the notice and pay the amount, then it should be paid and that is the end of the matter. They sometimes make mistakes so this can be appealed but there are deadlines to be met.
3. If you ignore their requests to pay, they can file a lien and seize your assets. This is a public document and it will show up in your credit report.
