The appeal process is utilized by taxpayers who disagree with a tax return audit resulting in additional taxes payable. Taxpayers have the rights to appeal various IRS actions including:
- Penalties and interest levied against a taxpayer
- Settlement by way of offer in compromise (link) was rejected by the IRS
- Installment agreement (link) terminations by the IRS
- Disputed liens or levies (link)
- Improper seizure of assets or bank garnishee
- IRS collections actions
An appeals office is a “separate and independent” IRS office but it is still the IRS, so we would recommend that you be properly represented by a tax attorney knowledgeable in these areas – and more importantly has your interest as a prime objective.
As a taxpayer you have the right to appeal incorrect decisions or assessments based on:
- Facts of the case were misunderstood
- Misinterpretations of the tax law
Many tax disputes with the IRS can be settled at the Appeals Office level. If that does not result in a satisfactory resolution there are additional remedies available:
- Case presented to the Independent Taxpayer Advocate
- Federal court – where the earlier avenues have not been successful
An appeal is utilized for situations where the tax owing is disputed but not when payment can’t be made. If the tax owing can’t be paid, then an installment plan (link) or offer in compromise (link) could be negotiated with the IRS.
